内陆税收局即日起展开两天追税行动(Ops KUTiP),追讨1631万令吉的欠款;Ops KUTiP是继综合税务行动(G127B)后,另一项追税行动。

从去年起展开频密追税行动,内陆税收局这次将目标锁定欠下高达3亿2619万令吉税务的3838家欠税公司与非公司,并委派592名官员在全国各地上门执法。

上述行动是该局放眼全年追回90%或2亿9357万令吉目标的举措之一,后续行动将陆续有来。

(吉隆坡8日讯)内陆税收局已鉴定全国3838家公司与非公司的欠税名单,并通过国内13个税收分局展开另一轮的追税行动(Ops KUTiP),两天内预计可追讨1631万令吉的欠税。

内陆税收局总执行长拿督沙宾沙米达说,这些欠税单位共欠下高达3亿2619万令吉的税务,上述行动是该局放眼全年追收90%或2亿9357万令吉目标的举措之一。

“592名执法官员即日起将展开为期两天的追税行动,该行动将在全国同时进行;此项大规模的执法行动旨在宣扬纳税人必须履行的税务责任,提高人民知法并守法的自警意识。”

沙宾沙米达今日在亚庇举行的“2017年第三阶段的全国亲民税务访问”上发表致词,并通过直播至全国各地。

“除了采取以上的执法举措,税收局从本月1日起,增设拥有200名法律相关官员的民事诉讼组,以加强处理逃税者分期缴税的案件与程序。”

他表示,追讨欠税涉及三个阶段,分别是稽查、警告及提控,法律途径通常为最后选择。

他也劝告纳税人应趁早缴还欠税,以减轻负担;众所周知,拖欠税金必须缴付滞纳利息,长久下去将令负担更加沉重,若依时缴税是可以避免这种情况的。

勿交现金予上门官员

内陆税收局副首席执行员(政策)拿督诺阿茲安强调,当局放眼今年追回90%被拖欠的税务,即2亿9357万令吉。

她也说,通过改善执法策略,当局有信心实现此目标;两天的追税行动料可收回1631万令吉,相等于3亿2619万令吉的5%。

可要求出示身分证明

“为避免任何欺诈及假冒事件,执法官员皆身穿税收局背心及携带证件;我促请纳税人在接受查问前,可要求官员出示有关身分证明,确保无误。”

诺阿茲安提醒纳税人,千万不要把现金交给上门的官员,因为他们不被允许收现金,并指纳税人所拖欠的税额只能通过支票或银行本票缴付。

联邦直辖区内陆税收局局长依德里斯坦言,追税行动并非一帆风顺,也有遇见不少追讨无门的案例。

“大部分至今仍无法追回的税务,其中原因有纳税人行踪无法追查,当中也有已逝世或破产者。”

有鉴于此,他认为应专注于最近的欠税,因为纳税人容易被检测到,可尽早解决这些税务问题。

PETALING JAYA: The Inland Revenue Board (IRB) has seized Country Heights Holdings Bhd’s (CHHB) executive chairman and major shareholder Tan Sri Lee Kim Yew’s fixed deposits placed with a foreign-owned bank amounting to RM126mil. 

Lee understood that it was in relation to a tax liability of CHHB’s wholly owned subsidiary, Country Heights Sdn Bhd (CHSB).   

CHHB said that the total tax liabilities of CHSB for the years of assessment 1997 and 1998 amounted to RM22.5mil.   

In a filing with Bursa Malaysia, CHHB said it received notification of this matter from Lee in a letter dated May 8.

This is the latest in the case of companies being forced to sell assets in order to pay tax bills. 

On Monday, MK Land Holdings Bhd also disposed of a parcel of leasehold land in Kamunting, Perak, for RM72mil.   

Among others, the disposal consideration would be utilised for working capital, corporate tax, real property gains tax and estimated incidental expenses amounting to RM47mil.   

Recall that on April 17, CHSB had been served with a winding up petition initiated by the Government in relation to a judgment sum of RM22.71mil.   

This amount was for a claim in relation to CHSB’s purported tax obligations, along with interest on the said sum at the rate of 5% per annum from Dec 28, 2016 and costs of RM2,500. 

In Tuesday's Bursa filing, Lee further informed that he has requested a confirmation from the IRB of the seizure and whether the seized funds have been, or would be applied to settle the tax liability. The IRB has yet to respond. 

Despite the absence of acknowledgement from the IRB, Lee has informed Bursa that he is agreeable to allow his fixed deposits seized by the IRB to be used to settle the tax liability. 

This is provided that the company acknowledges the sum used to settle the tax liability as an amount due and owing to Lee, and that the company undertakes to settle the amount as soon as the company has sufficient funds to do so.   

Lee has further agreed that the sum would be non-interest bearing. 

The board of CHHB has met Tuesday and, after due consideration, agreed to the above settlement.

疑绿野欠税2250万有关

(吉隆坡9 日讯)绿野集团(CHHB,5738,主板产业股)执行主席及大股东丹斯里李金友存放在外资银行的1 亿2600万令吉定期存款,遭内陆税收局扣押。


内陆税收局扣押李金友私人存款的举措,相信与绿野集团主要子公司绿野私人有限公司(CHSB)拖欠的2250万令吉税务有关,但暂未获得该局证实或回应。

绿野集团今天向大马交易所报备指,根据李金友本月8 日致给该集团的函件,据他了解,税收局有关的扣押是与CHSB的2250万令吉应纳税额有关。

据相关函件,李金友进一步通知,他已要求内陆税收局证实相关的扣押行动是款额被扣押,抑或是缴付有关的应纳税额。不过,税收局至今未作出回应。

“尽管未获得税收局的确认,但李金友同意上述遭扣押的私人定存,当成公司向李金友贷款来偿还应纳税额。公司也知道有关款项是用来偿还应纳税项,同时是拖欠李金友,直到公司有足够资金解决相关欠税。

李金友也同意,有关欠款不附加利息。

绿野集团董事部今天已开会讨论此事,并同意上述事项。

上述相关应纳税额是按1997年及1998年的年度估税计算出来。

去年12月,李金友已发出总额1076万令吉的无息贷款,让集团旗下的3家子公司缴还欠税。

税务欠款97金融风暴时欠下

CHSB早前因拖欠上述税务,遭政府发出清盘申请;无论如何,该公司当时表示有信心此事可以得到解决。

绿野集团早前也同样向交易所报备,政府是针对CHSB截至3 月7 日,所欠下的2270万6737令吉税务,发出清盘申请。

上述金额包括CHSB应缴交的2248万8593令吉税务、从2016年12月28日计起的5%年利息,以及2500令吉的成本。

该项申请是在今年4月13日提交给大马高等法院,并4月17日送到公司手中。

去年12月29日,绿野集团已解释,该笔税务欠款是在1997和1998年亚洲金融风暴时所欠下,公司已经致函财政部,对内陆税收局的决定展开上诉。

今年1 月24日,财政部已接受绿野私人有限公司的现金结算方案,不过,内陆税收局随后却表示,不接受该方案。

该公司随即委任PKF 税务服务私人有限公司,协助与税收局洽谈。

3 月10日,公司提出数个方案建议,以解决税务债款问题。

4 月3 日,税收局表示,解决方案有二,其一是由董事兼大股东丹斯里李金友拿出现金解决,或是由绿野集团发股给税收局。

CHSB同意任何一种解决方案,但在4 月5 日致函给税收局时,又再次遭到拒绝。

4 月6 日,PKF 税务和法律顾问再次与税收局代表见面。这一次,税收局表示,只要在4 个月内以现金解决税务债款,都可以接受。

4 月10日,公司准备合约,同时等待税收局的回应,直到接到清盘申请。

有信心解决问题

无论如何,绿野集团有信心,此事可以得到解决,因截至去年杪,绿野私人有限公司的净资产达1 亿1407万9000令吉。而集团的净资产则报7 亿9709万5000令吉。

目前,清盘还未开始,绿野集团在绿野私人有限公司的投资额共为260 万令吉,相等于0.3%的净资产。

该公司相信,绿野私人有限公司的税务欠款,可在下一次的清盘申请通知前得到解决。

而公司也会采取所有法律行动,挑战该清盘申请。

At least 13 millionaires have recently been ordered to settle tax arrears, and large corporations are feeling the heat, as the Inland Revenue Board flexes its muscles.

PUTRAJAYA: The Inland Revenue Board means business. And recently it has been targeting tycoons, including Tan Sris and Datuks, who owe hundreds of millions of ringgit in unpaid taxes.
The exercise, according to a report in The Star, is being undertaken separately by the IRB and the powerful National Revenue Recovery Enforcement Team (NRRET) under the Attorney-General’s Chambers.
The report said a Tan Sri in Penang and a Datuk in Johor were among the latest to be ordered to settle payments.
The NRRET is chasing after 13 millionaires, among others, over unpaid dues. The combined arrears of the 13 is believed to amount to almost RM50 million.
Set up in 2015, the NRRET is made up of the IRB,AGC, police, Malaysian Anti-Corruption Commission, Bank Negara, Customs Department and the Companies Commission of Malaysia, among others.

It deals with tax evasion, illegal outflow of funds and corruption.
The IRB is also going for companies which owe taxes. According to The Star, some of these companies are being forced to sell assets in order to pay tax bills.
The latest company to feel the IRB heat is Country Heights Holdings Bhd (CHHB). The IRB recently seized RM126 million in fixed deposits from CHHB executive chairman Lee Kim Yew, in connection with tax arrears owed by CHHB subsidiary, Country Heights Sdn Bhd.
The IRB carried out four major operations nationwide from January until May 9. The report said the IRB launched a campaign to collect unpaid taxes dating back to 2015, with 592 IRB officers knocking on doors to collect over RM326 million owed in the last two years.
The Star quoted IRB CEO Sabin Samitah as saying the IRB was not only improving its collection process, but also ensuring swifter legal action against those who refused to settle their arrears.
The IRB is also going after those involved in the “underground economy”.
Uncollected income tax is estimated at RM6.8 billion as of Dec 31 last year.
Meanwhile, Malaysians without business income have until Monday to do their e-filing.

他说,与一个马来西亚发展有限公司案有关的刘特佐,购买土地、产业以及作画,而该案也已经导致大马经济受影响。

(吉隆坡11日訊)內陸稅收局嚴打逃漏稅,近期頻密大規模追稅,更將許多欠稅名人搬上台面公告天下,雖說可取殺一儆百效果,但稅務專家認為,此舉恐弄巧反拙,引發人心惶惶、外資卻步,最終得不償失!

資深稅務專家、YYC集團總執行長葉欣向接受《中國報》電訪時說,當局追稅手法其實無需如此極端,也無需太高調,搞得街知巷聞、人心惶惶。

她舉例,最近被稅收局扣押存放在外資銀行戶頭共1.26億令吉定期存款的丹斯里李金友,就是最好的例子。



她說,欠稅還錢確是天經地義,納稅人應履行納稅義務,稅收局亦應該追稅,但當局採取高調且極端手法追討漏稅,只會引起市場尤其經商者的反感。

傳對付避稅外資

綠野集團(CHHB,5738,主要板房產)10日發布文告指出,相信和集團獨資子公司綠野私人有限公司(CHSB)拖欠2250万令吉稅務有關,以致集團執行主席兼大股東李金友存在外資銀行的存款遭內陸稅收局扣押。

葉欣向說,除了稅收局極端追稅手法打擊國內經商情緒,據悉關稅局也已開始對付企圖利用轉移定價(transfer pricing)方式避稅的外資企業,這將影響外資信心,導致原本打算進來的外資會很緊張,進而卻步。

13富豪2年欠5000萬

政府積極的追稅行動,分別由內陸稅收局及“國家追稅特工隊”(NRRET)執行。

《星報》報導,國內已有多位包括丹斯里級及拿督級大享遭追討所積欠稅款,據悉當中有13位百萬富豪,在不到兩年中,涉嫌積欠的款項就高達5000萬令吉。

成立于2015年的國家追稅特工隊,是由總檢察署、警方、反貪會、國家銀行、內陸稅收局、關稅局及大馬公司委員會(SSM)等組成,主要處理個人及企業機構逃稅、資金非法流出及貪污行為。

報導也引述高層情報指出,在檳城有一名丹斯里被指示繳清稅款,在柔佛州有一名拿督也被指示這么做。

今年至今4次大規模追稅

今年1月至5月9日,稅收局已在全國展開了4次的大規模行動,且將陸續有來。稅收局本週一(8日)也推出為期2天的追稅行動“Ops KUTiP”,以追溯回2015年起遭拖欠的稅款。

共有592名稅收局官員在上述兩天行動中逐一敲門追稅,成功回收過去兩年被拖欠、超過3億2600萬令吉的稅款。該局也放眼在今年12月前,回收在這段時間內欠稅總額的至少90%。

首相拿督斯里納吉在今年3月20日向國會透露,截至去年12月31日,未追收的稅額預計達到68億令吉。

稅收局總執行長拿督沙賓今年初已強調會大力嚴打逃稅漏稅,改善追收程序,同時確保迅速對拒絕繳清欠款的納稅人採取法律行動;那些涉及“地下經濟”活動的人也在該局的雷達中。

另外,為確保取得最新及最準確的數據,該局將與警方、關稅局、反貪會及地方政府等緊密合作。

該局稅收部門總監莫哈末依德利斯馬末也指出,許多欠稅案例已歷史悠遠,包括那些無法聯絡上、已往生或已宣布破產的納稅人。

跨國公司內部,在母公司與子公司、子公司與子公司之間代銷產品,提供商務、轉讓技術和資金借貸等活動所確定的企業集團內部價格。

KUALA LUMPUR: M K Land Holdings Bhd has become the latest public-listed group to announce the receipt of a surprise tax bill from the Inland Revenue Board (IRB).

In a filing with Bursa Malaysia on Monday, the company said wholly owned subsidiary Saujana Triangle Sdn Bhd (STSB) -- the developer of its flagship Damansara Perdana project in Petaling Jaya -- had been served with notices for an additional income tax of RM55.7mil and a 45% penalty of RM25.07mil.

The tax bill of RM80.77mil is in relation to years of assessment 2009-2011 and 2013.

M K Land said the IRB decided to impose the additional income tax and penalty for three reasons.

One, it considered the gains from the disposal of land held under Investment Properties in year of assessment 2009 as revenue in nature, instead of capital in nature.

The IRB has also disregarded the five-year time barred period to raise the said assessments in respect of the land disposal.

Finally, the IRB has disallowed certain development costs on the basis that these were only provisions and the amounts had yet to be paid. Thus it does not treat them to be incurred for the purpose of Section 33 (1) of the Income Tax Act, 1967 (as expenses that qualify for tax deduction).

M K Land said STSB disagreed with the assessments raised by the IRB and would therefore appeal.

Based on the advice from both its tax consultants and lawyers, STSB felt the land sales of the Investment Properties were capital transactions that were liable to real property gains tax (RPGT) in year 2009 (tax-exempt year).

(From April 2007 until the RPGT was reinstated on Jan 1, 2010, all gains from property transactions were exempted from the tax.)

In addition, STSB is of the view that the notices of assessment raised are statute barred and erroneous in law.

Further, according to STSB, the accrual of development costs has been allowed according to accounting standards and IRB’s public ruling on property development.

M K Land said it would make further announcement if there was any material update.

SELAYANG, May 23 — Sympathisers wanting to donate to Opposition parties are facing government intimidation, Tun Dr Mahathir Mohamad alleged last night.

Speaking at a Pakatan Harapan rally here, the former prime minister claimed the Inland Revenue Board was targeting those believed to be funding the Opposition pact.

However, he did not identify any of the people facing such harassment or provide evidence to support the claim.

“Now I heard that anyone who wants to donate to Pakatan Harapan will be harassed by LHDN,” he said using the Malay initials of the IRB.

Dr Mahathir was the main speaker at the rally that featured senior leaders of Pakatan Harapan parties including Selangor Mentri Besar Datuk Seri Mohd Azmin Ali, DAP national publicity chief Tony Pua and Amanah president Mohammad Sabu.

In his speech, Dr Mahathir also aid the purported harassment was intended to sabotage the pact's preparation for the 14th general election.


The pact's rivals understood that money was vital to running a successful election campaign, Dr Mahathir said.

“You need posters, buntings, and even to register candidates, it all requires money,” he explained.

大马中华总商会总秘书拿督卢成全透露,不少华商向他大吐苦水,因为遭到内陆税收局翻查旧账,一些是在7年之内,一些则超过7年旧账,令华商无所适从。

技术问题非蓄意欠税

他替被追税的上市公司说情,认为这些公司大部份是基于技术问题而发生“漏税”,并非蓄意欠税,因此希望当局能够“网开一面”。

“上市公司很多是技术问题,账目是由专业会计师审核,公司每3个月要提呈公司报表,账目清晰透明。一些公司可能是因为不晓得政府的税务奖励措施已过期而没有缴税,并非公司故意要逃税。”

他接受星洲日报访问时表示,有一些华商投诉上门稽查旧账和追税官员态度欠佳,像把华商当罪犯对待。

“或许当你投诉官员的态度不好,官员也可反口指责你说商家不合作,态度也不好。”

官员应友善对待商家

他认为,无论商家是有心或无意欠税,官员应该友善对待商家,不应情绪化滥用职权。

卢成全表示,税收局一向有展开追税行动,只是近期执法行动特别频密和严厉,若官员秉公执法和依据程序是不成问题的。

另外,税收局从明年1月起拖欠所得税的罚款,将从目前的6个月内缴付罚款45%增加至100%,而不论是公司或个人,都面对罚款加重的惩处。

孔令龙:数据误导非针对华商

马来西亚特许税务协会(CTIM)中央理事孔令龙受询时对星洲日报表示,近期他确实接获不少中小企业被内陆税收局追税的投诉,也包括一些大企业。

他说,我国的中小企业公司有超过一半的老板是华人,而我国的十大富豪有8个是华人,公司年营业额超过5000万令吉的也大多数是华人,政府这样的追税举动,不能被说成政府是在针对华商,这是数据上的误导。

针对万能被内陆税收局罚款和追税共4亿7600令吉,当中追税额是2271万令吉,不过罚款却高达4亿5375万令吉,他说,这当中涉及2个因素。

他说,万能的总公司是上市公司,只是投资公司,投资在子公司的股票上,其所有的营业都是在子公司。总公司并没有所谓的营利,总公司多数是投资在子公司的股份,而其回酬是利息。在税务法令下,股息是不需要被征税。在这种情况下,不懂万能的多少间子公司被查,同时也不清楚一年被罚的罚款额是多少。

他指出,一般上罚款额是45%,例如追税是100令吉,那罚款额的45%就是45令吉,100加上45,有关公司要支付的税额就是145令吉。

不过他说,税务局有一个条例,可以征收应缴税额的3倍。

他说,若要知道究竟为何万能可以被征收这么高的税额,就要看内陆税收局发给该公司的补税通牒。不论是漏税还是逃税,就算补缴了纳税人还是要罚款,就是应缴的税款加上罚款。

(吉隆坡26日讯)企业咨询专家龚铭恩指出,1967年税收法令82条文(5)节阐明,内陆税收局可追讨任何年份的税务。

他说,条文提到,如果内陆税收局总监对用于确定收入的记录资料不满意,可发出通知要求当事人提供所指定时段(通知书发出后30天内)经专业会计师稽查的账户或记录。


龚铭恩是Incorp会计及专业税务服务公司董事。他是针对內陆税收局最近的追税大动作,受询时向《南洋商报》发表评论。

近期较为瞩目的两个案例,一是绿野集团(CHHB,5738,主板产业股)执行主席及大股东丹斯里李金友存放在外资银行的1亿2600万令吉定期存款,遭内陆税收局扣押。

上周,万能被内陆税收局追讨4亿7647万令吉。万能向大马交易所报备的文告中指出,税收局针对2008年至2011年的估税通知书,其实已经超越了现有法令的时限范畴。

万能指出,在征询公司律师后认为,董事部有理由挑战通知书的合法性及罚金数额。

龚铭恩认为:“内陆税收局可援引许多条文去追讨7年前的税务,从新闻报道来看,此案例(万能)与82条文(5)节比较贴近。

“通常是之前已面对税务问题,且牵涉巨额,在经过漫长的官司和来函寻求上诉时,出现逾期的问题。”

内陆税收局上个月展开1270亿综合税务行动(简称G127B),1270亿令吉为内陆税收局今年的税收目标。

不追7年前税务
只适用守法者

龚铭恩说,过去遭追税的,可能是小企业,不过如今内陆税收局显然是“大小通追”。

他说,目前内陆税收局在发出估税税务通知书后,纳税人致函求情要求减低,会出现因为估税的算法,因估税过高而与纳税人所呈报有出入。

“一个例子为,一些时候我们迟报税,内陆税收局帮我们估税,通常会高过我们所呈报,于是纳税人致函求情,要求尽快将整个税务作出调整。

“内陆税收局通常不主动调整,所以出现拖延的可能性。这也是一般在发生的事情。

“许多时候是税收局在拖延,导致纳税人每天在还;还清了,对方还没把该做的税务调整做好。”

不管怎样,龚铭恩提醒,1967年税收法令虽有阐明,7年前的税务不容催收,不过这点只适用于守法的纳税人。

他指出,一般而言,守法是指每年依时报税、纳税,反之就是违例,7年前税务不可催收的条文未必适用于后者。

KUALA LUMPUR (May 27): Malaysia's Inland Revenue Board (IRB) is addressing taxpayers' non-compliance more vigorously this year to ensure consistent and sufficient government revenue collection for nation building, chief executive officer Datuk Sabin Samitah said.

The Edge Malaysia business and investment weekly in its latest May 29 to June 4 issue, quoted Sabin as saying the IRB had no "hidden agenda" and that the money collected from taxpayers went into the Treasury. Sabin said money in the Treasury was used for government spending based on the country's budget.
 
"There is no hidden agenda, as whatever we do is ultimately for the benefit of the people. The target for tax collection is not new to the IRB. It is set annually by the Ministry of Finance based on economic projections and other relevant variables. Likewise, enforcement against tax evaders is also something that has been part and parcel of our operations since day one.

"IRB acts as an agent for the government, by collecting the right amount of tax from persons liable to tax in Malaysia. Every sen collected goes to the Treasury and is then used by the government according to the annual tabled budget. Therefore, speculation that a portion of the money collected goes into a bonus pool for IRB officers and so on is not true," he said.

According to Sabin, taxpayers' non-compliance, whether a failure to report the correct income or pay taxes within the stipulated time, did not only affect the government’s revenue, but was also unfair to compliant taxpayers who contributed to the nation’s building without fail.

He said the IRB's strategies this year were based on the principles of making compliance easy and non-compliance difficult.

"We have taken steps to increase the quality and convenience of our services to facilitate taxpayers who consistently pay their taxes. Our aim is to increase tax awareness and voluntary compliance, and reduce tax leakages" Sabin said.

“从技术性的角度,可以被探讨的课题包括技术性的课题,税法允许税收局审查过去6年的税务,但现在很多个案是已经超过6年。”

税法诠释复杂需时厘清

蔡兆源指出,据了解,内陆税收局对税法的诠释蛮严格,而其诠释方式和纳税人及税务顾问是存在差别的,而这也需要被厘清。

“内陆税收局在针对税法作出诠释时,也会发出税务公众裁决(Public Ruling)。这里出现的一个问题是,如果根据这项裁决去呈报,税收局是否还有权利来追讨税务?”

他说,这样的情况也是纳税人和内陆税收局应该关注的课题。

鉴于目前有纳税人表示要就相关案件入禀法庭,蔡兆源指这样就交给法庭来判断内陆税收局是否有这个权限,能够就技术性错误,追讨超过6年以上的税务。

他说,过去较常出现的技术性和诠释上的问题包括收入是否会被征税、变卖产业的有关收入应该缴纳所得税或是产业盈利税、何时应该纳入损益表并且纳税。

其次则是扣税方面的问题,而这包括哪些开销可以扣税?

“目前发生的案件就是这些上市公司,母公司和子公司借贷的问题、母公司借钱去投资子公司,利息是否可以扣税,这些都是比较属于技术性的。”

追税或影响投资情绪

谈到近期个案的追税数额,蔡兆源指这些公司被追讨的数额并不小,而是上亿的庞大数额,而内陆税收局也应该考虑对企业和整个投资情绪可能造成的影响。

“我想,税收局应该从另一个层面去想,就是这样的做法是否会影响到个别纳税人的生意,而上市公司,是否也会影响其股价。”

他说,一旦出现这种超过时限的追税行动时,会让市场带来不确定的因素,也让企业和投资者带来隐忧。

他认为,内陆税收局也有必要考虑这类的行动是否会影响国内外投资者的投资意愿,而是否有这样的影响,也仍有待观察。

蔡兆源强调,纳税是大马公民的义务,但在国家积极追税的同时,是否也应考虑这样的做法是否会对国家经济带来影响,是否让商界有所忧虑。

他说,有关当局是否给予商机足够的机会来进行辩护,并解决这些问题。

“技术性的问题是可以解决的,因为不像逃税这般直接明了,必须要捉。那技术性的是否可以进行洽谈。”

他说,其实税收局也不倾向很建议商家把有关个案带上法庭,因此设立纠纷调解单位,鼓励针对税务课题和税收局有不同意见的商家,可先通过这个单位来解决,而不用耗费时间在法庭的案件上。

Board hauls up defaulters after voluntary disclosure deadline expires

PETALING JAYA: The Inland Revenue Board (IRB) is expecting an increase in tax revenue after actions to collect unpaid taxes have seen a number of large companies and prominent individuals being hauled up over unpaid taxes.

IRB acted against the tax defaulters after the deadline for them to voluntarily pay up expired.

“Our enforcement objective is really about increasing voluntary compliance. However, it cannot be denied that the activities will naturally contribute to the overall tax collection,” said IRB chief executive officer Datuk Sabin Samitah in an email interview.

“The activities are conducted on historical data that are based on the declarations or filings of returns made two or three years ago. Findings or revenues generated were based on their business performance from those financial years. We believe that IRB’s strategies for 2017 will address tax leakages which have put a dent in the nation’s revenue base.”

The pursuit of tax dodgers has been in the making for some time. IRB had rolled out a tax amnesty programme in 2015 and last year where individuals and corporations were encouraged to voluntarily disclose monies owed to the board. The penalty levied for the voluntarily cases was a fraction of the full brunt the board is now imposing on tax dodgers from this year.

“The recent publicity on our enforcement activities gives an impression of increased investigations by IRB.

“However, IRB as a tax administrator has been continuously carrying out investigations as one of its enforcement activities.”

Last month, Magnum Bhd and unit Magnum Holdings Sdn Bhd were served with notices of assessment with a penalty totalling RM476.5mil. Magnum said it and MHSB had appointed solicitors and are initiating proceedings to challenge the validity and legality of the notices of assessment.

Actions against Tenaga Nasional Bhd and Country Heights Holdings Bhd have also been taken in recouping what the IRB claimed had been unpaid taxes.

Sabin said the tax amnesty was to address tax penalties on audit or investigation cases and late payments. It was an effort by the Government to encourage taxpayers to come forward within a stipulated time to enjoy reduced penalties.

“It had the desired outcome in the sense that many cases were settled quickly, but the IRB understands the need to be fair to compliant taxpayers, and hence this year’s strategy is to address non-compliant cases more vigorously,” he said.

IRB said it employed sophisticated analytics to determine cases for audits. It said although big corporations hired the biggest auditors to handle their taxes, there are other high-risk criteria which may reflect profit shifting schemes, which when pursued uncovers big sums of unpaid taxes.

“IRB’s policy in selecting case for audit whether it is for corporate, business or individuals is to always be transparent and maintain its integrity,” he said.

Apart from using technology to sniff out unpaid taxes, the board also relies on other ways to detect cases. They include information from external sources such as informants, the media, public, and review of income tax returns.

“However, each individual or company has to be studied separately based on the merits and facts pertaining to the case. The elements of culpability and evidence are important factors in determining the actions to be taken,” Sabin said.

“The IRB will audit a taxpayer at least once in a five-year cycle, which translates into roughly 20% of taxpayers being audited each year.

“If the number of taxpayers increases, the figure of 20% will naturally result in an increase in audit cases. Hence the perception that IRB conducts audit more intensely or frequently now is really a reflection of an increase in numbers of taxpayers in Malaysia,” he said.

The amount of direct taxes the IRB has collected in recent years has stagnated at best with the amount collected in 2014 being the highest with RM126.7bil. That dropped to RM111.8bil in 2015 and the Government, in its economic report last year, estimated that tax collection for 2016 would be at RM110.5bil.

It was reported in March that uncollected income tax was estimated at RM6.8bil as of Dec 31 last year.

Sabin said that although a higher gross domestic product (GDP) would correlate to higher tax collection, there were many tax expenditures in the form of tax incentives or exemptions to attract foreign investment. Following the introduction of the goods and services tax in 2015, taxes for individuals and corporates were cut.

“Therefore, we may not be able to tax certain portions of income despite the apparent growth in the GDP. Malaysia has reducing income tax rates for individuals and companies to create a competitive tax environment compared with other neighbouring countries.

“Together with other tax expenditures, it lowers the effective tax rate. The increasing operating costs of businesses compared with growth in income reported especially among companies in the manufacturing and services sectors may also result in lower taxable income. With enforcement strategies carried out in 2017 to address tax leakages, IRB expects to see a growth in income tax collection.”

Sabin said that based on 2015 figures, 18% of the population paid taxes in Malaysia. He said the threshold of taxability was generally quite high, therefore a significant number of the population falls outside the tax bracket.

“In order to broaden its tax base, IRB has designed strategies to increase tax awareness as well as identify tax dodgers. Our aim is simple, to make compliance easy, and non-compliance difficult.”

Sabin dismissed suggestions that the audits were selective. He said that case selection was objective and based on advanced analytics and intelligence gathered.

“Our systems do not recognise taxpayers based on politics and race. We have always maintained our policy of carrying out our duty without fear or favour. As far as we are concerned, protecting the nation’s tax base and creating a level playing field is our goal. We also hope that our efforts to address non-compliance will eventually be seen for what it is, to benefit our country.”

(八打灵再也5日讯)内陆税收局将每五年审查一名纳税人至少一次,意味着每年约有20%纳税人被审查。


内陆税收局总执行长拿督沙宾沙比达针对上述情况强调,如果纳税人增加,每年约有20%纳税人被审查的情况,就会反映在不断增加的审查案件上。

根据《星报》报道,沙宾通过电邮接受访问时说,公众认为近来我们更频密审查,事实上只是反映了大马纳税人增加。

他相信,当局今年的策略有助降低漏税问题,预计税收也将有所增长。

“我们的策略是提高税务觉醒,并鉴定逃税者。”

沙宾:门槛太高  仅18%国人缴税

内陆税收局总执行长拿督沙宾说,2015年数据显示,只有18%大马人缴税,他认为,征税门槛相当高,导致大部分人口都无需缴税。

近年来,内陆税收局所收取的税收出现下滑趋势,从2014年的1267亿令吉最高税收额下滑至2015年的1118亿令吉,政府预计去年的税收为1105亿令吉。

据报道,截至去年12月31日,未收所得税预计达68亿令吉。

他说,尽管国内生产总值相对将会有更高税收,但是为了吸引外资,税务开销也增加,包括税务奖掖及税务豁免。

此外,随着2015年落实消费税,政府也降低个人及公司所得税率。

“因此,尽管国内生产总值显著增长,我们却不能对部分收入征税,大马降低个人及公司所得税率,以创建一个更具竞争力的税务环境。

“再加上税务开销,使实际税率降低,制造业及服务业营运成本上涨也导致可征税收入减少。”

加强力度向大企业追税

内陆税收局加强追税力度,近来更向大公司及显要追讨拖欠税务,此举预计将使当局的税收增加。

沙宾说,当局的执法目的是为了提升公众的自愿遵守率。无可否认,这些执法行动自然会增加整体税收。

他解释,当局是根据两三年前的资料采取行动,并根据公司历年的业务表现估算其收入,而2017年的策略将解决国内漏税问题。事实上,当局的追税行动已经持续一段时间,当局于2015年及2016年推出特赦计划,鼓励个人及公司职员披露所拖欠的税收。

沙宾认为,最近当局的执法行动宣传增加,导致人们认为当局加紧调查,事实上,当局只是不断持续调查,这也是执法行动之一。

“此举让案件快速解决,但我们了解必须对那些遵守的纳税人公平,因此今年的策略是加强力度对付违规的纳税人。”

利润转移仍难逃法眼

沙宾说,尽管大企业聘请审计师处理税务,但仍有其他高风险因素,可能反映利润转移,在当局追查时就会发现大笔未缴税款。

他说,内陆税收局是使用复杂的分析以鉴定审计案件。

他驳斥,当局选择性审查的说法,并强调内陆税收局是根据分析及情报,客观选择审计案件。

“我们选择审计案件的策略是保持透明度及廉正度,无论是企业或个人案件。

“我们的系统并不会根据政治及种族辨认纳税人,我们一直坚守不偏不倚的执行任务。”

除了利用科技找出未缴税款,当局也会依赖其他方式检测案件,其中包括来自外部的资料,如投报者、媒体、公众及审查所得税申报表。

“无论如何,每个案件都必须根据案件的情况及事实单独进行研究,证据及罪责是决定是否采取行动的重要元素。”

徵税之事,古已有之,不同的是,只在名目。朝代一变,税征自异:曰「役」、曰「赋」、曰「贡」、曰「助」、曰「彻」、曰「租」、曰「庸」、曰「调」、曰「捐」、曰「算緡」、曰「釐金」。

及至晚清,政府徵税,也是这样。有碍国库虚空,税捐之多,超乎想像。康熙旨下的「永不加赋」,纯属墙纸的装饰。除了海关,为了筹集镇压太平军的釐金税,由省而县,还要按照营业所得收取1%到10%的税率,似是清版的GST了。

不仅这样,凡有需要,往往临时开徵的赋税:「军需、河工、賑务、赔款之用,及歷次事例之开、盐商等报效、修河工料之摊征,凡为不时之入供不时之出者,为数均巨。」


此外,另有遵奉「捐纳」之名,肆无忌惮地找钱:賑捐、军火捐、海防捐、工捐、米捐、茶捐。有学者说:连价格表,全清楚列明瞭。总而言之,买官鬻爵,皆可按此缴付。

猖獗之极,一旦参考wiki统计纳捐出身的官员比率,足以知之:乾隆29年,22.4%;道光20年,29.3%,同治10年,51.2%,光绪21年,49.4%。沈垚计算,光绪六年,科班出身的朝廷命官,仅有两成之微。

JOHOR BARU – The Inland Revenue Board (IRB) has a special unit to monitor those who fail to pay their taxes, and will be looking at businesses and individuals who claimed to have become millionaires by joining multi-level marketing (MLM) schemes and online businesses.
The Investigation and Profiling Department will monitor individuals, businesses and companies which fail to pay taxes, according to IRB deputy chief executive officer (compliance) Abdul Manap Dim.
“Even if the MLM companies and online businesses did not register their businesses, they still have to pay taxes,” he said at a press conference after launching the second Operasi Gegar Bersepadu (G127B) at Wisma Hasil Johor IRD headquarters here on Tuesday.
He said those earning commissions, such as marketing employees, also have to declare their income.
Abdul Manap said the unit had ways to monitor individuals and companies who tried to escape from paying taxes.
“We take action based on evidence gathered by us such as through newspapers or magazine reports on, for instance, those who claim to have made millions from MLM and online businesses,” he said.

Abdul Manap said the IRB was confident of collecting RM127bil in taxes this year, up from RM114bil in 2016.
He added that the board had collected RM47bil as of last week from individual taxpayers and companies.

IRB audits 18 legal and architectural firms in Sandakan

KOTA KINABALU: Eighteen legal and architectural firms in Sabah's east coast Sandakan district are under the scrutiny of tax authorities.

The Inland Revenue Board is carrying out audits on six such firms and have up to 30 officers in various business premises.

"The audits are to ensure that the income reports these companies filed with us are accurate," said Sandakan IRB director Bacho Abdul Karim.

"If it is found that the companies have not submitted the correct reports, we will advise them to do so," he said Tuesday.

He said IRB has sent notices to 12 other legal and architectural firms that have failed to submit tax returns.

JOHOR BAHRU: The Inland Revenue Board (IRB) of Malaysia has launched the second series of its “Operasi Gegar Bersepadu” nationwide operation for this year to increase tax collection and go after tax dodgers.
Its deputy chief executive officer (compliance), Abdul Manap Dim, said the operation, which runs from today until June 18, targets 2,263 individual and company taxpayers running architecture and legal firms.

“The operation will be carried out for six days by 1,274 auditors from the IRB to ensure the declared income is accurate and proper,” he said in a statement here today.
Manap said the operation was a continuation of its first series, held from April 10 to 14, involving RM1.976 billion in taxes and penalties in which 3,793 taxpayers were audited and investigated.
Meanwhile, he said the IRB managed to collect a total of RM23.372 million in arrears via another nationwide operation codenamed “Ops Kutip”, which was aimed at collecting taxes immediately on arrears under two years.

(新山13日讯)内陆税收局本月13日(周二)至18日,展开第二回合的全国大查税,并已鉴定全国2263家公司与非公司的查税目标,放眼今年全国可追收以达到1270亿令吉的税收目标。


*锁定绘测师、律师个人及其公司

*“外部审计”上门实地审查

*“桌面审计”要求呈文件供审计,锁定没据实报税的个人或公司

*13州分局1274税务官同步行动查税及鉴定逃税者

*今年截至上星期,个人及公司已缴纳470亿令吉税收

*税收局在审计中,发现一些公司呈报股息税务方面出现不少失误

鉴定2263家查税目标

内陆税收局今日(周二)起至本月18日,展开今年第二回合的全国大查税行动,并已鉴定国内2263个公司与非公司的查税目标,其中包括绘测师、律师个人与公司,和其他个人或企业。

这项行动命名为1270亿综合税务行动(Operasi Gegar Bersepadu简称G127B) ,该局全国13 个分局同步行动,参与的税务官人数多达1274人。

行动宗旨包括对全国锁定为查税目标的专业人士,如绘测师和从事律师的个人及公司和其他企业,展开税务审计,确保他们正确的申报与纳税,并遵守条规。

内陆税收局副总执行长(遵法)阿都马纳今早在柔州内陆税收局主持次轮行动挥旗礼仪式上,发表谈话,并通过直播至全国各地。

他指出,这是内陆税收局加强追税力度,提高税务觉醒,并鉴定逃税者和发出警告讯号。

柔州方面,查税行动主要集中在新山市区,包括依斯干达特区范围。

缩小范围登门实地审查

阿都马纳说,次轮大查税已缩小范围,主要进行的审计方式有二:首先是通过“外出审计”(audit luar),当局会派执法官员拜访纳税人或其公司进行实地审查,这主要针对绘测师和律师等。



“另一种方式是桌面审计”(audit meja),我们会要求查税目标,提呈文件供审计用途,这锁定那些没据实申报税务的个人或公司。”

他透露,桌面审计方面,会有469名官员负责审查1461个纳税人,外出审计则由805名官员负责审查802个纳税人。

至于1270亿综合税务行动,意指该局今年的1270亿令吉税收目标。

阿都马纳披露,截至今年6 月初(上星期),该局已获得个人及公司缴纳高达470亿令吉的税收,并表示有信心可达到今年目标。出席仪式者包括内陆税收局情报与监测局主任哈江、柔州内陆税收局局长南利等人。

监督传销商炫称百万富翁者

内陆税收局已成立特别单位,专司监督那些参与传销和电子商务等网上生意,并声称本身已成为百万富翁的人士。

此外,当局会运用各种方式,包括监督媒体如报章或杂志的访问内容,多方收集资料与证据,以追查那些逃税者。

阿都马纳说,税收局会监督个人如受薪人士、商人和任何公司企业,包括传销和网上生意,即使没向大马公司委员会注册,这些人也一样需要缴税。

他说,那些赚取佣金的市场人员,也需要申报收入。

“我们可以通过情报与监测局这个特别单位,通过分析与情报找出未缴的税款。”

他在记者会上解释,根据税务法令,一家公司若有发佣金给员工,就必须保存记录,税收局会在这方面进行审查。

另外,内陆税收局情报与监测局主任哈江致词时说,今年第二回合的全国大查税,是由该局与税务遵法局联手,在国内同步进行,查税目标也包括沙巴和砂拉越地区。

他指出,被列入“桌面审计”的案例,执法官员将会亲手交到纳税人手上。

50公司列查税目标
21家逃税额加罚金约10亿

阿都马纳说,截至5月25日,共有50家公司因退税额偏高或涉嫌通过激进税务规划逃税,被列为查税目标。

他说,截至5月杪,我们已审计了其中的21家公司,涉及的逃税额加上罚金,高达约9亿7180万2000令吉。

“税务审计结果发现,这些公司把单层股息收入和应注销的减免,当成开销申报。”

同时,他说,也有一些公司在可赎回优先股的可抵免股息呈报上出问题。

“其他呈报上的问题,包括公司借贷给有关连公司、预扣稅、资本津贴等。”

首轮追回逃税加罚金逾19亿

今年4月10至14日第一回合的内陆税收局全国大查税行动中,有3793个纳税人被审查,涉及逃税额加上罚金,共高达约19亿7600万令吉。

阿都马纳今日在记者会上,也公布第一回合大查税行动详情,涉及该行动的各分局税务官共2117人,所执行的查税行动包括:

●审计公司业务

★拜访1248家商店,登记167新纳税人名单。

★另外的1081纳税人已有申报所得税。

●把拖欠税务通告及法庭行动通告呈给纳税人或公司

★发出2596张通知书。

★涉及拖欠税额达2亿1709万9000令吉。

●审计税务

★针对1122名雇主和纳税人,发现有雇主没有遵守呈报员工预扣税额(PCB)条例。

★涉及逃税额加上罚金达5亿4232万9000令吉。

●调查税务

★调查71个涵盖房地产发展商、投资公司、批发公司、食品制造公司、餐馆、承包商、书店、诊所以及矿业等领域的纳税人。

★涉及逃税额加上罚金高达约2亿5845万令吉。

★另外,特别行动组也调查4家公司(房屋发展商、承包商及房地产领域业者),涉及逃税额加上罚金高达约9亿5842万令吉。

★一家公司名下户头1800万令吉存款被冻结。

●纳税人醒觉教育

★举办50场电子报税说明会或柜台活动,7083个纳税人出席。

第一回合大查税审计查获的违规行动

●申报时申请超过它实际可享有的商务开销预扣

●实际销售额报小数

●购货成本报大数

●申报其他收入时的调整部分计算错误

●申报超出实际数额的资本津贴金

●预算税收时在捐款或捐献项目上申报错误

●少报收入

●在计算所得税中错误呈报捐献和礼物的数额

已追回2337.2万欠税

截至今年5月31日止,内陆税收局通过税务审计行动,已经分析及统计出44亿令吉的缴税款。

他说,该局在5 月8 及9 日的为期2天“追税行动”(Op KUTiP),向那些拖欠税务少于两年者追讨欠款,截至5月25日,追税行动已追回2337万2000令吉的税收。

另一方面,针对绿野集团执行主席及大股东丹斯里李金友存放在外资银行的1亿2600万令吉定期存款,遭内陆税收局扣押一事,阿都马纳仅简短回应说:“案件目前仍在调查中。”

查山打根18公司

(亚庇13日讯)内陆税收局展开今年第二回合的全国大查税行动,东马山打根18家律师楼及绘测公司成查税目标。

据《星报》报道,内陆税收局山打根分局主任巴卓阿都加林表示,有6家类似的公司及各商业大楼多达30名职员正接受税收局的审计。

“审计是为了要确保这些公司提呈给我们的税收报告是准确的,若发现该公司没提呈正确的报告,我们会建议他们这样做。”

他也指出,该局已发通知书予未报税的另12家律师楼及绘测公司。

JOHOR BARU: Make sure you are ready to pay taxes before you declare that you have become an instant millionaire by joining multilevel marketing schemes and online businesses.

The Inland Revenue Board (IRB) is keeping an eye on those who make such claims.

IRB deputy chief executive officer (compliance) Abdul Manap Dim said 3,793 people were hauled up for various offences in the first-leg of Operasi Gegar Bersepadu from April 10 to 14.

“Apart from salaried employees, businesses and companies have to pay taxes including multilevel marketing (MLM) schemes and online businesses. It is unfair to other tax-payers that MLM and online businesses escape from paying taxes,’’ said Abdul Manap.

Abdul Manap said those earning commissions, such as marketing employees, also have to declare their income, and pensioners who are still working and contract workers were also taxable.

“For instance, if you are a salaried worker and at the same time you own an online business, you have to pay double taxes,’’ he said.

He added that tax dodgers will not be able to get away as staff at the Investigation and Profiling Department of IRB have ways to identify and monitor them.

Abdul Manap said the IRB was confident of collecting RM127bil in taxes this year, up from RM114bil in 2016, adding that the board collected RM47bil as of last week.

Abdul Manap was speaking after flagging off the second-leg of Operasi Gegar Bersepadu (G127B) at the Johor IRB headquarters Wisma Hasil here yesterday.

He said no one would be spared, including politicians, people with titles and companies.

“Generally, Malaysians have improved a lot over the years in settling their taxes promptly but there are still evaders,’’ said Abdul Manap.

He said the number of Malaysians with outstanding taxes prevented from leaving the country by the Immigration Department has reduced.

(布城15日讯)过去5年,外国专才拖欠税务超过5000万令吉,为了防止类似事件发生,内陆税收局与移民局联手合作,禁止拖欠税务的外国专才出入境。


将商讨落实的机制

移民局总监拿督斯里慕斯达法阿里指出,两大机构将商讨落实的机制,并向政策组汇报后,才能决定落实禁止出入境政策的日期。

“本地人拖欠税务或高教基金都会被禁止出境,外国人也必须面对相同的禁令,确保他们在离国前缴清应缴税务。”

多数来自服务业

另外,内陆税收局总执行长拿督沙宾指出,拖欠税务的专才多数来自服务业。

他补充,当局也会审计专才猎头公司,因为这些公司在介绍外国专才给本地公司所获得的佣金,往往没有申报。

两大机构今日推介Hasil MyEXPAT系统时,做出上述宣布。

THE Inland Revenue Board (IRB) has yet to confirm whether its seizure of Country Heights Holdings Bhd executive chairman Lee Kim Yew’s fixed deposits is related to a tax liability incurred by its subsidiary, The Sun reported today.

During its AGM yesterday, independent non-executive director Nik Hassan Nik Mohd Amin said Country Heights’ tax consultants and lawyers were still discussing with IRB on how to resolve the issue.

Nik Hassan said that Country Heights has also agreed to pay back the tax liability to Lee as the amount was a small sum compared with the group’s assets of more than RM2 billion.

The group has been making losses since 2015. For the first quarter ended March 31, 2017, the net losses widened to RM7.85 million on lower revenue of RM18.71 million.


On May 9, Country Heights announced to Bursa Malaysia that IRB had frozen Lee’s fixed deposits amounting to RM126 million.

It said the action was related to a RM22.5 million tax liability by subsidiary Country Heights Sdn Bhd (CHSB).

Lee previously notified the group that he believed the action taken was in relation to RM22.7 million worth of tax liabilities incurred by its wholly owned unit and major subsidiary, CHSB, which were accrued from the assessment years of 1997 and 1998.

Lee said he was agreeable to allow his seized fixed deposits to be used to settle the tax liabilities, provided that the company pay back the amount with no interest, which was agreed to by the board.

He did not attend yesterday’s AGM, citing business overseas. His daughter Lee Cheng Wen, who is also deputy chairman of Country Heights Holdings, read out his three-page emotional message to shareholders.

In it, Lee told the story of a pregnant deer going into labour in the midst of many dangers, appearing to allude to the group’s predicament and its focus on getting itself out of losses while dealing with the authorities.

He asked shareholders to brainstorm with members of the board on corporate recovery strategies and the future business of the group.

He also said the group will recalibrate its focus on property development and spin off the rest of the non-core businesses as associated activities.

Lee said the group now has total bank borrowings of RM122 million and no other tax arrears matters once the outstanding RM22.7 million tax liability incurred by CHSB is settled.

The group has consolidated net assets of more than RM797 million and a combined landbank of 2,470ha with a net book value of about RM1.2 billion (before any revaluation).

A shareholder, who attended the AGM and brainstorming session yesterday, told SunBiz that the group’s subsidiary tax liability issue is not a big concern to the shareholders but its losses are.

“Just (questions) on the losses of the company (were raised by the shareholders) and they promised to do better, at least in three years’ time,” she said.

Another shareholder, who also declined to be named, told SunBiz he is confident that the group will resolve the tax issue and believes that its consultants and lawyers will handle it accordingly.

The brainstorming session, which lasted about one hour, was attended by the board of directors and shareholders. – June 22, 2017.

A+ A A- The wrath of Spanish tax authorities inflicted on high-earning football greats in the likes of Cristiano Ronaldo (Real Madrid) and Lionel Messi (Barcelona) somehow bears semblance to the recent spate of tax woes impacting Country Heights Holdings Bhd’s founder Tan Sri Lee Kim Yew, numbers forecast operator Magnum Bhd and property developer MK Land Holdings Bhd.

Whether the alleged wrongdoers are business entities or individuals, what is universal of the tax audit or tax investigation meted out by the Inland Revenue Board (IRB) is that such exercise is a common enforcement mechanism to ensure compliance with the tax laws and regulations.

Beyond that, it has to be borne in mind that listed companies – as in the case of Country Heights, Magnum and MK Land – are highly regulated by numerous rules and mandatory reporting requirements that must be adhered to.

IRB says it can collect outstanding taxes even after death

The Inland Revenue Board (IRB) says it is legally empowered to collect outstanding taxes even after someone has died.

"IRB is empowered in accordance with Section 74 and Section 106 of the Income Tax Act 1967 to claim a deceased's outstanding tax from the rightful next-of-kin.

"If the next-of-kin is not able to pay the whole sum, IRB advises the next-of-kin to visit IRB's office to discuss paying in instalments," it said in a statement today.

Section 74 of the Income Tax Act 1967 states: "Where an individual dies in the basis year for a year of assessment, his executors shall be assessable and chargeable to tax for that year of assessment, for the following year of assessment and, whenever necessary, for any previous year of assessment in respect of the chargeable income of that individual for any such year of assessment; and, where they are so assessable and chargeable, they shall be assessable and chargeable to tax in like manner and to the like amount as the individual would be assessed
and charged to tax if he had not died".

Section 106 of the same Act allows the government to recover tax due and payable through civil proceedings as a debt due to the government.

IRB made the explanation in response to a Facebook post by one Amran Mohamed complaining about the IRB pursuing his outstanding taxes from his wife after claiming that he had died.

In Amran's case, the IRB said it had mistakenly thought that Amran had passed away and apologised for the error

lhdn-taxKUALA LUMPUR: The Inland Revenue Board (IRB) has denied it sent a refund notification email to taxpayers which went viral on social media.
IRB, in a statement today, said it would directly credit the excess income tax payment that had been processed based on correct information to the bank account of taxpayers through the electronic fund transfer or tax refund voucher and crossed cheque.
According to the statement, the surplus on income tax refunds for those with overseas accounts would be credited through telegraphic transfer.


“The fake email sent requires the taxpayer to click on the attached link as a procedure to check the eligibility of receiving the tax refund.
“IRB advises all taxpayers to be alert and not to respond to any instruction in the email,” said the statement.
Taxpayers can contact IRB Care Line at 1800-88-5436 or the nearest IRB branches for prior verification of any notification received.
The IRB branch numbers are available at its official portal www.hasil.gov.my.

FINANCE minister II Johari Abdul Ghani has denied the raid on firms owned by Dr Mahathir Mohamed’s sons by tax officers was politically motivated.

He said the Inland Revenue Board (IRB) is tasked with collecting taxes and to carry out investigations should there be any evidence of tax evasion.

“The IRB is an independent body free from any political hold. They can carry out investigation on anyone.

“As long as they (have) enough evidence, they can do so. No one can tell the IRB who it should investigate. I don’t think the motives are political,” he said after officiating at the Society Empowerment and Economic Development of Sabah (Seeds) in Kota Kinabalu today.


Tax officers on Wednesday raided Kencana Capital Sdn Bhd, owned by Dr Mahathir’s second eldest son Mokhzani, and seized files related to 11 companies under the group.

They also raided Opcom Holdings Bhd, chaired by Mokhzani with Mukhriz Mahathir as shareholder, and Crescent Capital Sdn Bhd, where the former prime minister’s third son, Mirzan, is the chief executive officer.

Marina Mahathir, Dr Mahathir’s oldest child, said the raids on her brothers’ companies were not a coincidence. 

Johari said the IRB routinely investigated firms owned by the government, adding that “it won’t be a problem if companies had settled all their dues”. – August 11, 2017.

GEORGE TOWN: The Inland Revenue Board (IRB) is conducting visits, audits and investigations on 7,829 tax payers nationwide under an operation called “Op Saji” in an effort to enhance the public’s compliance with tax laws and regulations.
IRB deputy chief executive officer (compliance) Abdul Manap Dim said the operation would focus on the food industry chain, and include restaurants, caterers, cafeterias, as well as food processing and food business-related activities.
The operation, to be conducted from Aug 14 to 25, would involve three activities, namely business census tours, tax audits and tax investigations, he told reporters after the launch of the operation here today.
He said during the visits, the IRB would interview owners of business premises, gather business information and check if the business was registered with the board.

“After that, a thorough audit review on companies and individuals carrying out food-related businesses will be conducted and they may face additional assessments and penalties if found to have submitted wrong assessments,” he said.
Manap said the penalty rate would be 45-100% of the amount of under-declared tax.
He said 1,479 officers from 37 IRB branches nationwide would be involved in the operation.
Meanwhile, in his speech at the event, Manap said the IRB would conduct the operation more frequently to enhance the public’s compliance with tax laws.

內陆税收局首席执行员拿督沙宾表示,这次行动的目標主要集中在专业人士,包括律师、教授、工程师、会计师等。

「专业领域的人最常见的就是谎报薪水。他们没有依实呈报自己的收入。」

当记者询及彻查对象是否包括政治人物,他先是否认,后来改口说如果他们逃税同样会採取行动。

上门查大型餐厅

沙宾出席內陆税收局举办的爱国庆典后,召开记者会说明此事。他点出,当局將从多方收取资料,以国家银行、第三方、银行的个人財务风险分析报告,甚至是僱用的会计师蒐集证据。

「当局只有在掌握证据后,才能展开行动。最了解实情的就是会计师,只是他们不敢举报而已,但他们是持有详细资料的。」

他也点出,国內有许多大型餐厅没有缴税。

「许多小型餐厅或摊位都不需缴税,他们在扣除成本、租金等开支后,大多都是无须缴税的,反而我国有许多大型餐厅没有缴税。我们会上门彻查清楚。」

他补充,內陆税收局也会趁著彻查行动期间,教育人民有关税收的知识。

內陆税收局曾在去年杪宣布20亿令吉特別专案行动(TB2B),锁定8个领域,包括金店和当铺、电子商务、合法借贷公司、医药界、走私活动及合法准证(汽车),追查潜在逃税者。

当局也在8月14日至8月25日展开食品行动(Ops Saji),针对全国各地的食肆、小贩及食品加工厂展开税务调查工作,让逃税业者无所遁形,也提高商家履行缴税责任的意识。

The Customs Department and the Inland Revenue Board (IRB) have formalised their partnership to conduct audit operations together, effective from today.

Customs director-general Subromaniam Tholasy and IRB chief executive officer Sabin Samitah signed a standard operating procedure (SOP) for their joint audit programme in the presence of Treasury secretary-general Mohd Irwan Serigar Abdullah today.

INCOME tax collection has almost doubled since Prime Minister Najib Razak took office in 2009.

From RM60.3 billion in 2010, the collection is estimated to reach RM112.3 billion in 2017, according to data obtained from the Treasury Department.

"The cumulative annual growth rate (CAGR) from 2010-2017 is 11%," said Rafizi Ramli in a statement today.

The CAGR rate of 11% was high when the average economic growth was only 5%, said the Pandan MP.


Rafizi said it was impossible for income tax collection to be double of economic growth.

"As such, I can only conclude the rise in income tax collection by the government is due to Inland Revenue Board's aggressive audits on businesses associated with Pakatan Harapan and collecting taxes from dead people," said Rafizi.

The introduction of the Goods and Services Tax was premised on low government revenue was low because many Malaysians did not pay taxes, said Rafizi.

But the higher collection over the past six years showed otherwise, said Rafizi.

"But as GST became a burden to Malaysians, Najib's administration is now chasing taxpayers on back taxes."

Rafizi said the government's promise to reduce the tax rate after introducing GST had not materialised either. – August 30, 2017.

Speaking to FMT, IRB CEO Sabin Samitah said IRB’s enforcement strategies have only one objective — to make compliance easy and non-compliance difficult.
“This is important to create a fair tax system, especially for taxpayers who have been compliant in fulfilling their tax obligations.
“We would like to stress that our audit and investigation activities are carried out on all non-compliant taxpayers, without taking into account age, race, gender or political inclination.”
Yesterday, Rafizi, the Pandan MP, said the IRB was targeting opposition supporters and even the dead and that he had proof.
He reasoned that the increased income tax collection, which was disproportionate to the country’s economic growth, was due to “aggressive audits on businesses associated with Pakatan Harapan and collecting taxes from dead people”.

Rafizi added that social media had also been reporting cases of IRB sending notices to those who were already dead.
On notices sent to the deceased, Sabin said the practice was not unusual as it was a norm to collect tax debt which must be settled.
“IRB collects taxes based on the Income Tax Act 1967, and not merely through the normal practice,” he said, adding the outstanding debt of deceased individuals would be collected from the administrator of their estate or next of kin.
He said the IRB would send notices to the last known address of a deceased individual who had outstanding debts.
“The administrator of the estate or the next of kin may contact any IRB branch to obtain more information regarding the tax standing of the deceased.”
It is understood that countries like Singapore and Australia also require the executor of a deceased person’s estate to settle that person’s tax matters.
Previously, the IRB had said that professionals, including lawyers, architects, engineers and doctors, will be its next target group in upcoming audit operations.

Eric-See-ToPETALING JAYA: The Barisan Nasional Strategic Communications (BNSC) team says that contrary to recent claims made by the opposition, there is absolutely nothing unusual about income tax collections outpacing the country’s economic growth.
In a statement issued today, BNSC deputy director Eric See-To outlined three possible scenarios that could lead to such a situation.
He said the first involved the increased profitability of companies, combined with rising income levels and the higher number of taxpayers.
Citing Tenaga Nasional Berhad as an example, See-To said the company’s profit before tax had increased from RM1.5 billion in 2009 to RM8.1 billion in 2016.
The pre-tax profits of Maybank meanwhile increased from RM1.7 billion to RM8.5 billion in the same period.
“The income levels of Malaysians also increased substantially during this period leading to higher tax collections,” he said, adding that this had resulted in more individuals becoming “honest taxpayers”.
The second scenario, See-To argued, was increased tax compliance.
More stringent enforcement and the implementation of the GST, he explained, had encouraged companies that had previously not registered with the Inland Revenue Board “to come clean and pay their fair share of taxes and report more truthful sales figures”.

“The last scenario is that income tax and corporate tax rates have increased.”
See-To’s statement today followed Rafizi Ramli’s claim in a live Facebook telecast yesterday, that income tax collection had grown disproportionately compared with the country’s economic growth since Prime Minister Najib Razak took office in 2009.
See-To also took issue with the Pandan MP’s decision to compare the tax collections in Malaysia in 2010 to Australia’s tax collection average growth of 5.3% during the same period.
Rafizi, he said, failed to state that the GDP growth of Australia was just 2.7% during that period, which meant that tax collections had also outpaced economic growth there.
“Australia’s example shows that income tax collections outpacing economic growth is not unusual.”
Last night, Rafizi, who is PKR vice president, said that from RM60.3 billion in 2010, income tax collection was estimated to have reached RM112.3 billion in 2017, according to data obtained from the Treasury.
He also said that the cumulative annual growth rate (CAGR) from 2010 to 2017 was 11%.
Rafizi further claimed that the rise in income tax collection was due to the IRB’s “aggressive audits” on businesses associated with Pakatan Harapan and their tendency to collect taxes from those who had deceased.

PETALING JAYA: The Inland Revenue Board (IRB) has denied a claim made in a viral WhatsApp message that each of its officers has been given a target to collect RM6 million in income taxes for this year.
It said no such targets were set for the audit officers, and that the board took any allegations that its staff had behaved in an unprofessional manner for such a purpose seriously.
“IRB would like to inform that the annual tax collection target is set by the government and it is made known to the public during the tabling of the country’s annual budget by the finance minister.
“Therefore, IRB’s initiatives and strategies to achieve the target set had been planned as early as November 2016, and implemented beginning January 2017,” it said in a statement today.
It said all its target initiatives, strategies and status were monitored by the ministry and the IRB’s board members comprising representatives from the public and private sectors.
Without revealing details, it said tax collections thus far for 2017 had shown that there would be more collected compared to last year.


“Besides that, Malaysia’s economic growth of 5.8% in the second quarter of this year, as reported by Bank Negara on 18 August 2017, shows that Malaysia’s economy is able to surpass the previous projection of 4.3% to 4.8% set earlier,” it added.
The Whatsapp message claimed that the finance ministry has set a target for IRB to collect RM127 billion in taxes. It said taxes collected as at Aug 2017 amounted to RM69 billion which was 54% of the amount.
“Thus, keeping valid documents and compliance to accounting-related regulations are very important. Please be prepared to handle difficult tax officers during tax audit as they have a huge pressure to hit their KPI (RM6 mil per officer),” the text said.
IRB also reminded taxpayers to keep records on their incomes and expenses for a period of 7 years, as stipulated under the Income Tax Act 1967, to facilitate checks during an audit by IRB.
It advised the public to contact IRB if they face any issues during the auditing process and lodge a complaint with them by providing the relevant officer’s name, date of audit and the issue that arose during auditing

PETALING JAYA: The Inland Revenue Board (LHDN) has refuted claims that it raids offices of opposition supporters and makes baseless demands for additional corporate tax.

Speaking to FMT, LHDN chief executive officer Sabin Samitah said if any taxpayer was dissatisfied with their assessment after an audit or investigation, they could make an appeal to the Special Commissioners of Income Tax (SCIT) within 30 days.

In a recent blog post, former prime minister Dr Mahathir Mohamad in repeating his allegation that government agencies, including the LHDN, were targetting opposition supporters, said the agency had been squeezing opposition supporters for additional corporate tax.

Sabin added that SCIT was an independent body which had the authority to listen to any objections by the taxpayers.

“The SCIT’s decision can also be appealed at the High Court or the Court of Appeal. The rights and interests of taxpayers are well protected under the Income Tax Act 1967.”

Sabin also said that LHDN doesn’t disclose information on individuals or companies that are being audited or investigated as it was bound by the secrecy provision under Section 138 of the Income Tax Act 1967.

On Mahathir’s claims that the LHDN was targetting opposition supporters, Sabin said LHDN’s case selection for enforcement purposes was based solely on a company or individual’s failure to comply with existing tax laws.

“LHDN doesn’t keep records of race, religion, what more, of the political inclination of individuals in its database because such information doesn’t assist in the risk analysis of a case.”

In his blog post, Mahathir, the Pakatan Harapan chairman, had lamented that opposition parties were unable to raise sufficient funds for their activities as the government had put the squeeze on its donors.

He claimed people with the means and willingness to donate to opposition parties were being threatened and pressured, including by the LHDN, police and the Malaysian Anti-Corruption Commission.

Mahathir also claimed that if the LHDN’s “targets” refused to pay up, their companies would be blacklisted, and their accounts and records seized which would paralyse their business.

(吉隆坡27日讯)2018年財政预算案宣布下调个人所得税率2%,超过26万1000人无需缴纳所得税,主要受益者为中等收入群体(M40)。

首相拿督斯里纳吉今日宣布2018年財政预算案时,向230万名纳税人宣布下调个人所得税率的好消息,即可征税收入2万至7万令吉的个人所得税率,將一律减税2%;估计將让纳税人节省300令吉到1000令吉税金。

首相说,可徵税收入介于2万1令吉至3万5000令吉者,税率从5%减少至3%;可徵税收入介于3万5001令吉至5万令吉者,税率从10%减少至8%;可徵税收入介于5万1令吉至7万令吉者,税率从16%减少至14%。

纳吉说,为了提高国人的家庭可支配收入,及收窄国內的收入差距,收入少过9000令吉的40%中等收入群將获得减税。

这项宣布也符合早前普遍预期,不少专家认为,政府已经至少3年没有调低中等收入群的个人所得税率,为配合大选临近,作为派糖果的措施,2018年財政预算案应该会有所下调。

根据2018年財政预算案附录显示,可徵税收入介于2万1令吉至3万5000令吉者,节省幅度最大,高达60%,可节省的缴税金额从原有的500令吉减少至200令吉,可节省300令吉。

可徵税收入介于3万5001令吉至5万令吉者,税率减少至8%后,缴税金额从现有的2400令吉,减少至1800令吉,节省600令吉,节省幅度25%。

可徵税收入介于5万1令吉至7万令吉者,税率从16%减少至14%之后,缴税金额从现有的5600令吉,减少至4600令吉,节省了1000令吉,节省幅度17.86%。

CYBERJAYA: The Inland Revenue Board (IRB) has included the audit of 15 banks in Malaysia that have offshore dealings as part of its “Operasi Mega 2017” (Ops Mega 2017) — the tax authority’s biggest tax awareness operation this year.

IRB deputy chief executive (compliance) Abdul Manap Dim said phase one of the audit will involve the audit of 15 banks, comprising both local and foreign ones.

“We will audit these banks that have offshore transactions, for example those with transactions in Labuan. We will also look out for potential transfer pricing issues due to different tax rates imposed on entities in Labuan, and those in Peninsular Malaysia.

“We have started our checking, and we are now going through the information provided by these banks that are involved,” he told reporters after launching Ops Mega 2017 here yesterday.

However, he declined to share the targeted collection amount from the banks as the audits are still ongoing, but said the amount “could be huge”, perhaps “somewhere in the hundred million ringgit range”.

The number of tax cases that will be audited under Ops Mega — including the banks — is 4,158. These audits, which will be conducted throughout the country, started yesterday and will be concluded on Dec 1. The audit will involve a comprehensive check on identified taxpayers to ensure their reported income is accurate. It is also aimed at raising the level of tax compliance in the country.

The overall Ops Mega 2017, which started on Nov 20 and will also end on Dec 1, involves 4,219 tax officers out of IRB’s 11,000-strong workforce nationwide. Besides tax audit, it also involves tax investigation, tax collection, civil lawsuit, and raising awareness of taxation and compliance.

Under Ops Mega, it is initiating some 1,393 lawsuits over total unpaid taxes of RM120.127 million. It will also be conducting surprise visits to business premises, homes or offices as part of its tax investigations. The investigations, involving some 204 cases — comprising both individuals and corporations — are to identify tax evaders, whom IRB will also charge in court.

As for its efforts to raise awareness of taxation and compliance, the IRB has lined up 104 programmes, like briefings and the distributions of brochures, besides sending out emails to 59,920 taxpayers — mostly first-time taxpayers — to educate them on their responsibilities and rights.

It has also sent out reminders and notices to 6,560 individual and corporate taxpayers who have accumulated unpaid taxes amounting to RM434.175 million.

Abdul Manap said operations like Ops Mega will aid IRB in achieving its 2018 tax target of RM134.7 billion, which is 6% higher than its 2017 target of RM127 billion.

The higher target was set despite a potential RM1.3 billion in taxes lost due to the two-percentage-point reduction in personal income tax involving 261,000 taxpayers announced in Budget 2018.

As for its 2017 tax target, Abdul Manap said: “[God willing,] we will achieve the [2017 target]. To date, we have collected close to RM109 billion in taxes.”
